Owners of pirated VCDs, beware

KUALA LUMPUR: The Government is considering taking action against the owner of even one pirated video compact disc although it is meant for private use, said Domestic Trade, Cooperatives and Consumerism Minister Datuk Seri Ismail Sabri Yaakob.

“Under the law now, any person who has one pirated VCD is not guilty, but if the person owns more than three, action can be taken.

“My personal view is that if a person owns one pirated VCD it is already an offence,” he said after opening the World Intellectual Property Organisation Seminar Malaysia on the creative industry here yesterday..link

If the government 'beria-ria' nak banteras cetak-rompak, they should have lower down the cd price. And stop taxing us with those stupid taxes. Also, if they really wanted to take actions, I think the whole Malaysia citizen will be going to jail. Just do something concrete. There is one pirated cd shop near my house and it was just behind a police station. What a joke.

I guess almost every M'sian has one at least, but you should go to Miri, Sarawak and see for yourself. All shops selling this products are littered with pirated VCD's / DVD's.

Its strange but a true fact that no action has been done for years on this shops. ALL Authorities in Miri are the most lousiest & heavily taking bribes by trucks full.

If the government wanna take action, clean up Miri City first of this and gangsterism controls the city.

Okay, pirated VCD is way out of date. People now uses pirated DVD?!
Gov should go after those SELLING pirated CDs first...

A lot of them are selling in broad daylight, in shop lots nonetheless...
But if can, the original PLEASE BE ORIGINAL!!! Not some reprinted from original and sold as original (bad quality), a typical "original" VCD/DVD seller only on this country. And even the worse is.... And for the reason i fewer buy original is....they "CUT" some scene here and there until not worth to buy it.
I think it is good idea to punish the private user of pirated VCD in order to combat pirated VCD culture. Most of the users keep their pirated VCD in their home. Are they going to start checking every house with court warrant? If yes, they should start from his house to every house of his ministry's staffs.

P.S. How about pirated DVD?
and some of the pirated DVDs are actually produced by the originals distributors.(sometimes pirated against originals by the ratio of 10:1 or more.)

that is because they can pay less royalties to the originals suppliers.

what type of action can be taken?

1. If people are imprisoned, Govt must build a huge prison, which has to shelter most of head or sons or daughters of the families of Malaysians as well as foreigners and illegal immigrants residing here.

2. If people are fined, it will be a good income for the govt to compensate the losses incurred by Petronas. GLCs and heavilly budgeted multi billion projects....

Sabri should have spoken through the papers, not surely through the knowledge.

An additional note to explain the capability of Malaysian Police, there is a pacific Mall behind a Police station in JB.

EarlySpring, i have to agree with you. Just to add, the Malaysian Censorship Board is "ridickulous". They ban movies and part of movies with lousy or lame justification. Anything Jewish cannot show. Anything gay related cannot show. Anything that challenges the national religion cannot show. Pure poppycock. Piracy still has its place in the society given the lame reasons propagated.
The malaysian policy makers are a big joke! One hand allows pirated CD/DVD/VCD sellers on the streets and at the same time wants to penalise buyers.

They just do not know what to do!
First of all..those vcd traders are only working for their living. They wish to have more proper job but socio-economic & education drag them down to the pit. No choice.
2ndly, the original VCD/DVD are too expensive to buy. Lower the price la. Even the 10 yrs old vcd cost $15.00!!
Our income generally are just enough for survive, just a bit extras..need some entertaiment(cheap) buy pirate dvd.
Going to cinema nowadays are not cheap either, imagine a family of 2 kids go for a show..cost you ard $50.00 excluded dinner..etc.
3rdly, before you saman us for pirate vcd/dvd, check your govt. officers homes first.
I'm sure there is plenty of pirate vcds..saman la!!

when this ismail fellow started this topic, i can think of 101 reasons (maybe not 101 la because don't have so much time to list everything down) to make him regret with what he said.

1st of all, is it to really protect film producers or protect your cronies? hollywood film producers are having their movies pirated all over the world & they are still making tons of money.

2nd, ismail, please think of the main reason why we malaysians are buying pirated dvds instead of originals or watching it in the cinema. its because your "creative" government keep thinking of ways to suck our money with stupid taxes. if it weren't for taxes, we could afford to spend on originals. does anyone notice that the movie tickets they buy have something called "duti hiburan"? this is another 1 of many stupid taxes by malaysian government for malaysians

3rd, malaysian censorship board have a very good reputation of being the holiest in the world. they would even censor a little kissing scene. with all the censoring, do you think i will spend my money to watch a movie which has been "potong" here & there?

Finally, of course its easy for this ismail guy to tell us to buy originals, because the cds or dvds which he watches or listens are i'm sure bought with tax payers money, just as any government official would do, so if you don't mind, can we have OUR money back so that we can spend it wisely just like how our pm wants us to?
Indeed if the action is properly implemented, nearly all Malaysians would fill the jail to the brim. I think everyone that I knew have at least one pirated disc, regardless of whether they knew the concept of intellectual piracy or not.

Let's face it; it's the golden age of (intellectual) piracy. Maybe we even have our own privateers among the top-brass in the government, plundering (intellectual rights) loot from the pirates.

On a side note, the 'duti hiburan' is actually for the film producers or distributors, and is used to measure the film achievement. By rule, it should be reclaimable by the producers. How far is this implemented, I'm not sure. I'm not even sure if the government can go a long way to return the duties to foreign film producers.

given the ideal that there is no pirated DVDs in the market, there is no proof that particular show (on original DVD)will attract any buyer.

to be frank, i view some shows because some mamaks bought the pirated DVDs and played them at their shops.

without pirated DVDs, the mamaks will not buy any, and i just end up not getting to view that show. It simply doesn't mean that the 'selling power' of a pirated DVD will go to the originals, right?

Talking about pirated VCDs, reminds me of an incident in a govt department. One of the boss gave IT contract to a private company to supply and maintain pc and programmes for a research project.The programmes for the research projects were installed in 100 pc, used for data collections. Everything is ok, til one day, the state boss dropped by to check the progress of the researh work. Suddenly there was a commotion in a room, he was heard shouting at the top of his voice. Guess what?. He was shocking when he found out the research programmes softwares on all the pc that he checked were not genuine!. So, the minister should check his own office 1st for any pirated softwares before his enforced the law to go after the general public.
If everyone who owns pirated DVD would go to jail, the the police, fireman, RELA and government servants will all go to jail. The who is going to arrest those selling DVD's?
First of all pls lower down the cd's @ dvd's price and pls do not cut the movie 'till the main point of the story is totaly gone...

I enjoyed watching movies with UN-CUT version..and pls la...now days DVD also out of date..now we download movies from internet... much more clearer and free
Nowadays if you have a computer with internet you could just download whatever movies you want to watch as mentioned by benhajar. Even though I don't. So you don't even need to buy fake/pirated movies anymore.

I always watch movies in cinemas, the experience is 100 times better compared to viewing at home, with fantastic surround sound. If not I will buy original DVDs and watch it with my Playstation 3 with my family.

I've only bought original music CD albums because I want to support the music industry.


The government has noting better to do. Every now and then they will scratch their heads and think of some foolish ideas and new laws.

Try putting those with pirated DVD/CDs into jail and the jails will be flooded with people including civil servants and even law enforcement officers.
Don't worry lah. True, the law on piracy is very clear, even one single pirated CD/DVD is subject to prosecution. But you and I know the govt is good only at talking but never enforcing any laws. It is unlawful to smoke in public air-conditioned places but many folks do that, it is illegal to park indiscriminately in town but everyone does that, jaga kereta is illegal but there are still many of these guys around, racing on the road is illegal but Mat Rempits are thriving, etc.
How is it fair to us that we have to go through the stress of knowing whether a disk is legitimate or not?

Buying endangered animal parts is an offence and it can be clearly defined but as for a pirated disk, there is no mention of whether it is original or a pirated copy, unless there is a sticker on it that states ‘pirated copy’.

I am quite certain that even the holographic stickers used by our government to identify original disks can be counterfeited.

I have recently purchased some original disks from Amazon.com and there were no funky stickers on it that states that it is original like how our government does it. If it is to be in the hands of our local enforcement officers, they would probably assume that it is they are pirated copies.

This issue should be arrested from the source.

Judging from the article, there is no mention of arresting the problem at the source (The people responsible of making pirated disks and selling them). It is like saying drug users should be arrested while drug dealers and drug lords are not to be touched.
wat i dislike is when buying ORI disc, many scenes been cut here n there...compare to 'uncut movies' on pirated disc.

come on.. we pay to enjoy da movie.. not enjoy see 'scissor-happy-cutted-movie'...
Both pirated and original Hong Kong TVB series DVD are SUCKS. So, who want to purchase?

Hong Kong TVB now broadcast content and film drama series in 16:9 wide screen format. But, pirated and original DVD for the same drama released in 4:3 format. I will never buy the DVD unless the DVD videos follow the original filming, released in 16:9 format.
